Terms of Service

These terms cover work we carry out for your business — website builds and revamps, local search visibility, social media and AI automation. They are written to be read, not hidden.

1. About these terms

These terms apply when Finch Stone Digital Ltd (“we”, “us”) provides services to you or your business (“you”). By accepting a written proposal or instruction from us, you agree to them.

Finch Stone Digital Ltd is registered in England and Wales as a private limited company, company number 17434118. Our registered office is Business Opportunity Centre, Lenton Boulevard, Nottingham. NG7 2BG. Contact: hello@finchstonedigital.co.uk.

2. Our services

  • AI website builds and revamps for small and medium-sized enterprises (SMEs).
  • Google and local search visibility improvements.
  • Social media presence and consistency support.
  • AI automations and enquiry handling, including practical setup and guidance.

3. Quotes, proposals and scope

Before work starts we will confirm the scope, timings and price in writing. That written proposal is the agreement for that piece of work, and these terms sit alongside it. Where a proposal says something different from these terms, the proposal takes priority.

Written quotes are valid for 30 days unless the proposal says otherwise. Work outside the agreed scope is quoted and agreed separately before we start it.

4. Payment

Payment terms and schedules are set out in your written proposal. Invoices are payable in UK pounds sterling by bank transfer unless we agree otherwise.

Late payment may attract statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998. Where a project spans more than one month, we may invoice in agreed milestones.

5. What we need from you

Good work needs good inputs. We ask you to provide content, access, images and feedback reasonably promptly, and to confirm decisions when we request them. Delay in providing these may shift agreed timelines; we will always tell you if that happens.

6. Intellectual property

Once an invoice for the relevant work has been paid in full, you own the final deliverables we created for you — including the website design, content and configuration produced for your business.

We keep our own pre-existing tools, methods, templates and know-how, and we may reference completed projects in our portfolio unless you ask us in writing not to. You confirm that content you give us (text, images, logos) is yours to use and does not infringe anyone else’s rights.

7. Third-party platforms

Our services often involve platforms such as Google, Meta and website hosting providers. Those platforms have their own terms, fees and availability, which can change without notice. We are not responsible for changes they make, for policies they enforce, or for outages on their side.

8. Results and no guarantees

We work in good faith and follow established, practical approaches. However, search rankings, social reach and enquiry volumes depend on many factors outside our control, so we cannot guarantee specific rankings, traffic numbers or sales outcomes. What we do guarantee is clear communication and honest advice about what is realistic.

9. Confidentiality

Each side will keep the other’s non-public information confidential and use it only for the work in hand, unless the law requires disclosure.

10. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim connected with our services is limited to the fees you paid us for the work giving rise to that claim. We are not liable for indirect or consequential losses, including lost profits or lost data. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

11. Cancelling or pausing work

Either side may end an ongoing arrangement by giving reasonable written notice — 14 days unless your proposal says otherwise. If you cancel partway through a project, you pay for work completed up to the cancellation date, plus any committed third-party costs we cannot recover.

12. Changes to these terms

We may update these terms from time to time. The version in force is the one published when you accept a proposal; we will flag any material change before it applies to ongoing work.

13. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Before court action, we will both try to resolve any dispute by good-faith discussion.
